PERSONAL DATA PROCESSING AND USE OF COOKIES POLICY
- The purpose of this personal data processing and use of cookies policy ("policy") is to inform the customers and participants of the Composers Summit ("event") organised by the company Soundsgate s. r. o. registered in the Commercial Register kept by the Municipal Court in Prague in section C, insert No. 262567, with its registered seat at Salvátorská 931/8, 110 00 Prague, Czech Republic, ID No.: 05368235 ("company") and the persons visiting the web interface ("users") on the websites www.composers.cz and www.composers-summit.com focused at informing about the event ("web") operated by the company, about the processing of their personal data in relation to the event and the web operation, including about the policy regarding the use of cookies. This policy outlines which personal data and cookies, to which extent the company processes (uses), for what purpose and period, who are the other recipients and what are the purposes of such hand-over of personal data, and what are the rights of the data subject in relation to the processing.
- The data controller responsible is the company. Contact details of the company are its registered seat address and the address for delivery of electronic mail (e-mail): info@soundsgate.com.
Legal basis, purposes, period and type of personal data processing
- The company processes personal data to the extent of the customer's name, surname, gender, citizenship and e-mail address (if they are a natural person) and the participant's name, surname, gender, citizenship and e-mail address (if they are a person different from the customer), for the purposes of exercising the rights and obligations of the agreement, on the basis of which the customer (natural person or legal entity; "customer") purchased from the company the authorization ("accreditation") for the participant's (natural person; "participant") entry to the event ("agreement"). The legal basis and the purpose of such processing is the agreement and further the fulfilment of statutory obligations applicable to the company.
- The company further processes personal data to the extent of:
- photographs and audio and audiovisual recordings of the participant for the purposes of the par. 24 of the terms and conditions of the entry to the event (www.composers-summit.com) ("terms") – unrestricted distribution of photographs and audio and audiovisual recordings of the participant taken at the event for the presentation and promotion of the event and the company and its other projects for a period of 70 years,
- name and surname, gender, citizenship and e-mail address of the customer and the participant for the purposes of the par. 25 of the terms,
- e-mail address provided by the user for the purpose of sending a commercial communication related to the company and the event and informing about news (newsletter), and
- analytical/statistical and marketing cookies for the purposes and under the conditions pursuant to the following part hereof on the use of cookies,
and in these cases, the legal basis for the processing is the consent given by the data subject. Consent may be revoked at any time in writing by a letter to the company's registered seat address or by electronic means to the company's contact e-mail address (info@soundsgate.com), without prejudice to the legality of the processing of personal data based on the previous consent that occurred before the revocation.
- If the person ordering the accreditation is a person other than the data subject (participant), such other person (customer) warrants to the company that they shall inform the data subject about the extent of the processing and of their rights and undertakes to the company to do so.
- The personal data shall be processed for the maximum period of 5 years after the event, and beyond that for the period necessary for purposes of archiving according to the relevant generally binding regulations, but not longer than for the time required by such regulations, and in case of processing on the basis of the data subject's consent given for a certain specified period, for such period, but no longer than until such consent's revocation. The personal data may also be processed automatically, as well as by other technical means, but always only to the extent necessary for the purposes and legal basis of such processing.
Other recipients of personal data
- Other recipients of personal data may be persons providing organizational and technical services for the company (especially legal, accounting or tax advisors, and IT support). In case of conclusion of the agreement under the terms, other recipients of personal data may be the company's partners, and other persons participating in the fulfilment of the agreement and on the event's execution.
- The company does not intend to transfer the personal data to a third country (a country outside the EU) or to an international organisation, with the exception of transfer of personal data between the company and the company Stripe, Inc., San Francisco, California (United States of America), which, through its payment gateway, handles all payments (payment of accreditation) for the company, exclusively for the purposes of payment processing and the agreement performance, and only to the extent necessary for such purposes while maintaining the high level of protection required under the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Use of cookies
- Cookies are text files containing a small amount of information that are stored in the users' devices when visiting web and then are returned to the web or another website that recognises them on each subsequent visit. Cookies perform a variety of tasks, such as enabling efficient navigation between websites, remembering user preferences and generally improving the user experience. They can also ensure that the advertisements displayed online are better tailored to the user's personality and interests. Certain types of cookies allow identification of a specific person, thus constituting personal data, and are also covered by other sections hereof on the data processing. The company's web uses the following types of cookies:
- necessary cookies that are designed to ensure the full and faultless functionality of the web – this category of cookies cannot be disabled,
- analytical/statistical cookies, which allow the company in particular to recognise and track the number of users and how are they using the web, and to improve the way the web functions, e.g. by allowing users to easily find what they are looking for – this category of cookies can only be run with the user's prior consent,
- marketing cookies, which are used to track preferences and allow the company to deliver advertising and other content that best matches the user's interests and online behaviour – this category of cookies can only be run with the user's prior consent.
- Third parties (incl. external service providers) may also use cookies and/or access data collected by cookies on the web.
- Further information about cookies and the current list of cookies can be found via the individual web browsers, most often under Developer Tools.
- Consent to the use of analytical/statistical and marketing cookies can be granted by means of a check box contained in the so-called cookie bar, and later on, it is possible to refuse the use of such cookies and revoke the consent granted to their use (except of the necessary cookies) or to adjust the use of cookies setting to only some of the cookies available in the settings of the user's web browser.
Rights of the data subject
- The data subject has a right to require from the company an access to their personal data, to have rectified or completed inaccurate or incomplete personal data, to have restricted the processing of personal data, to object to processing of personal data, to data portability, as well as other rights arising from the Personal Data Processing Act and the General Data Protection Regulation. The Author also has a right to file a complaint with the responsible supervisory authority.
- For the Czech Republic territory, the supervisory authority is the Office for the Protection of Personal Data.
- The data subject is not obligated to provide their personal data; however, their provision is a necessary contractual requirement for the conclusion and the performance of the agreement.
Conclusion
- This policy's effective version is accessible from the company's web, and is available in Czech and English language versions (in case of any discrepancies between the Czech and English version, the Czech prevails). The other language version is available www.composers-summit.com. Previous versions of the policy are archived by the company in electronic form and are not accessible.
- This policy is effective from January 1, 2024.
